 A cautionary tale on online libel

The Villablagon & Associates, the Law Firm that handled their client, beauty business owner Pauline Clare Basilides', cyberlibel case against Aira Jane Barredo (owner of Miss Ayyang Thai Beauty Shop on Tiktok), another beauty business owner, who tried to besmirch their client's reputation online.

Pauline, while employed in Australia, entered into a business of skin care distribution in 2018 and 2019 where he supplied products to several online sellers, including that of the defendant. It was due to false accusations posted by Aira that Pauline filed a legal action based on a violation of Sec. 4 (c) (4) of Republic Act 10175, the Cybercrime Prevention Act of 2012, otherwise known as the Anti-Cybercrime Law.

During a press briefing at the Max's Restaurant in West Triangle, Quezon City, the law firm shared the court's favorable decision for their client. After months of worry and anxiety, Pauline finally heaved a sigh of relief, especially when she finally won the case she filed.

"The Court found that the accused posted false, malicious, and defamatory statements online; branding our client as "scammer" and subjecting her to public ridicule and reputational harm."

The presiding judge of the case, Hon. Rocille S. Aquino-Tambasacan issued a decision on June 26, 2025 in the City of Imus, Cavite ordering the accused to pay a fine of Php 40,000 or subsidiary imprisonment in case of insolvency.

In sharing the case's decision, Villablagon & Associates said the court emphasized that no justifiable motive was present, and malice was presumed.

"To those who continue to spread lies under the guise of expression: Be warned! As this case has proven, no one is above the law, even in cyberspace," advised the law firm.

This case is to inform influencers on the dangers of using their platforms irresponsibly. The ethical use of social media will have gone beyond its bounds when free speech becomes defamation. Netizens need to be extra careful because their actions could impact the mental health and personal reputation of other people.

It is hoped this case calls to action the promotion of responsible digital citizenship.
